The lawsuit between the US Securities and Exchange Commission (SEC) and Ripple over the issue of unregistered securities has been going on for more than 2 years. However, it appears that the end of the litigation is not far off, and therefore all parties concerned are concerned about what will happen if Judge Analysis Torres makes a decision. If Ripple is acquitted on all charges, then most likely the SEC will go to an appeals court. However, it will take some time for the court to make a decision. Meanwhile, US crypto exchanges, which delisted the XRP token in connection with the SEC lawsuit, may offer it for trading again. Lawyer James K. Filan suggested that the authorities would prevent this by asking Judge Torres not to enforce the order until the appellate court's decision was made. In his opinion, such tactics by the SEC will lead to further litigation between the two parties. On the other hand, attorney Hogan argues that Judge Torres cannot grant such an SEC motion if Ripple did not violate the Securities Act of 1933. “If she simply decides that there was absolutely no violation of the Act, then what else can be 'postponed' other than the usual claims for reimbursement after the decision is made?” Ripple is currently up 0.77% at XRP/USD $0.3453 while the weekly loss is -9.10%. The cryptocurrency continues to trade below the 23.6% Fibonacci retracement at $0.3649. The daily range has been steadily declining since December 19th. Until the 23.6% Fibonacci retracement resistance is broken on the daily close, a test of the $0.3203 cycle low should be expected. Above this resistance, the rally will be more likely to continue towards the 38.2% Fibonacci retracement of $0.3926. Resistance is reinforced by the 55-day moving average of $0.3954 and the psychological level of $0.4000. Above this level, attention will shift to the 50% Fibonacci retracement of $0.4149.
